Uniform Civil Code: Uttarakhand has taken one more step towards Uniform Civil Code (UCC). The committee formed to implement the Uniform Civil Code in the state has completed its work. Justice Ranjana Prakash, a former judge of the Supreme Court and head of the expert committee that prepared the draft, gave this information on Friday. Justice Desai said that along with gender equality, the committee has tried to bring all classes on equal footing by eliminating discrimination.
India Today report states that the draft of the proposed UCC has considered the rights of the LGBTQ+ community. However, these have not been made part of the recommendation as the matter of giving legal recognition to gay marriage is still in the Supreme Court and a decision is yet to come.
Live-in, consent in draft
India Today quoted sources as saying that the panel discussed issues such as uniform age of marriage, live-in relationships and children born out of such relationships, registration of marriages, age of consent for sex, early childbearing, etc. Issues like birth have been taken into consideration. Raising the age of marriage for women has also been considered in the draft.

Justice (retd) Ranjana Desai said that the report of the committee would be published soon and submitted to the government. He told that the committee has tried to understand the ‘nuances’ of various traditional practices prevalent in different parts of Uttarakhand. Our emphasis is on ensuring gender equality keeping in mind women, children and persons with disabilities. We have tried to eliminate discrimination and bring everyone on a level playing field. Desai said the committee has studied existing laws in various countries, including Muslim countries, but declined to share their names.
The committee was formed last year
The Uttarakhand government had constituted a committee of experts in May last year under the chairmanship of Justice (retd) Desai. The committee has been set up to look into various existing laws relating to personal civil matters of residents of Uttarakhand and draft legislation or legislation or changes to existing laws on subjects such as marriage, divorce, property rights, succession, inheritance, adoption and maintenance.
