‘The final decision will be of LG only’, important things about the ordinance of the Center brought in Delhi, AAP said this


Modi Govt Ordinance Against Supreme Court: The central government on Friday (May 19) brought an ordinance in relation to the Supreme Court’s order in which Delhi government was given control of the service department. Recently, the Supreme Court gave a unanimous verdict that the Delhi government has legislative and executive powers over public order, police and services except land.

Taking a big decision, the Central Government has overturned the decision of the Supreme Court. The central government has brought this ordinance for transfer posting of officers in Delhi. Through this ordinance, the powers of transfer posting of officers have been given to the Lieutenant Governor of Delhi, Vinay Kumar Saxena.

Important points of the ordinance

A National Capital Civil Services Authority (National Capital Service Authority) will be created to recommend transfer posting of all officers in Delhi. In this, the Chief Minister of Delhi, the Chief Secretary and the Principal Secretary of the Home Department have been made members and the decision will be taken by majority. It has been clearly written that the quorum for the authority meeting will be of 2 people, that means even if the CM does not come, the meeting will be valid.

The recommendation of the authority will be sent to the Lt. Governor and the final decision will be of the Lt. Governor whether he accepts that recommendation or not. It has also been clarified that the Legislative Assembly of Delhi will not have the right to make laws on the subjects of Central and State service officers.

What did the AAP government say?

On the ordinance, Delhi government minister Atishi said that it is contempt of the Supreme Court. Fearing to give power to Chief Minister Arvind Kejriwal, the central government has brought an ordinance. Arvind Kejriwal has been elected by the people of Delhi, but he wants to run Delhi.

Delhi cabinet minister Saurabh Bhardwaj said this

Delhi’s cabinet minister Saurabh Bhardwaj said, “The Center has perpetrated deceit and treachery with the Constitution of the country and the order of the Supreme Court. It has been said in the ordinance that the Chief Minister who has been elected thrice by the public will not have rights, while the LGs who have not been elected but have been imposed will have rights. This is a contempt of the Supreme Court, an insult and I do not think that before this so much deceit has happened in the country.

what next?

Explain that the ordinance will have to be approved by Parliament in the next Parliament session. A bill will be brought for this. Politically, the LG was again made the boss of Delhi. Who will act as the representative of the President.

During the hearing in the Supreme Court, advocate Abhishek Manu Singhvi, who appeared on behalf of the Delhi government, has given a sharp reaction to the decision of the central government. He tweeted that the new ordinance will be closely scrutinized but clearly it is the work of a bad, weak and graceless loser.
