Anti Tobacco Warning: Taking a major step to curb tobacco consumption in India, the government had issued a notification to display anti-tobacco warnings on OTT Platforms. After this decision of the Union Health Ministry, the country’s big OTT platforms like Netflix, Amazon and Disney have discussed adopting a legal option on this decision in a private meeting on Friday. According to the report published in Money Control, these platforms are afraid that they will have to re-edit the content of hours. In such a situation, he has decided to take the legal route.
Government issued this notification
On the occasion of World No Tobacco Day, the Union Health Ministry had issued a notification under the Cigarettes and Other Tobacco Products Act, 2004, asking OTT platforms to display at least 50 seconds of anti-tobacco disclaimers on scenes containing intoxicants and tobacco, both audio and video. Joining it will be mandatory to show it. OTT platforms will also have to display static anti-tobacco health warning messages when tobacco products are shown in all programmes.

Netflix held a closed-door meeting with Mukesh Ambani’s Jio Cinema app and said that the government’s decision will affect customer experience and may lead to production houses blocking their content. Along with this, companies may also have to re-edit their hours-long content. Apart from this, the streaming giants have also discussed legal options on this matter. The OTT platform says that the Ministry of Information and Broadcasting i.e. IT has the right to regulate the OTT platform. In such a situation, the Health Ministry cannot order them.
No official statement came from OTT platform
News agency Reuters has tried to talk to both the OTT platform and the Ministry of Health on this matter, but so far no one has commented on the matter. It is worth noting that in India, there is already a rule to display anti-tobacco health warning messages on TV scenes of tobacco or alcohol. Now the government is trying to apply it on OTT as well.
