Karnataka News: Karnataka Deputy Chief Minister DK Shivakumar on Monday (June 12) filed a division bench appeal against the sanction granted to the CBI to prosecute him. The petition filed against the approval given by the state government to the CBI was dismissed in the single bench of the Karnataka High Court.
A division bench of Karnataka High Court Chief Justice Prasanna B Varale and Judge MGS Kamal heard Shivakumar’s appeal. The court ordered the state government and the CBI to issue notices to register their objections and adjourned the hearing.
CBI had registered FIR in 2020
Shivakumar’s counsel argued that the sanction was given with a motive of hatred and hence it should be set aside. The trial was approved by the state government on September 25, 2019, following a request from the central agency. After which the CBI had registered an FIR against him on October 3, 2020.
Shivakumar challenged the sanction of the trial before a single bench of the High Court. Justice K. Natarajan had dismissed the petition on April 20, 2023, which has been challenged in the division bench. In 2017, the Income Tax Department had conducted a search and seizure operation at Shivakumar’s offices and residence.
These allegations against Shivkumar
After the Income Tax Department, the Enforcement Directorate (ED) started its investigation against Shivakumar. Based on the ED’s investigation, the CBI had sought permission from the state government to register an FIR against him. Objecting to the petition filed before the single judge, the CBI had said that the accused cannot demand which agency should investigate against him.
It was argued that since the CBI was enacted under a special Act, there was no need to mention the reasons for granting sanction for prosecution. Shivkumar has been charged under Section 13(2) and Section 13(1)(e) of the Prevention of Corruption Act.
