Azam Khan Hate Speech Case: Trouble continues for Samajwadi Party (SP) leader Azam Khan in Uttar Pradesh (UP). In dozens of cases going on against him, the trial is going on in the MP-MLA court of Rampur. In the hate speech case, Azam Khan was acquitted by the sessions court in the past. This case was related to Azam Khan’s provocative speech during the 2019 Lok Sabha General Election, in which he was sentenced to 3 years. His assembly membership was also lost, but after the acquittal of the lower court, the prosecution department has now completed preparations to appeal in the High Court.
District Magistrate Rampur has signed and recommended the appeal proposal prepared by the prosecution. Now the way has been cleared to appeal in the High Court at the government level. Somewhere due to this, difficulties may once again increase for Azam Khan. In this regard, Joint Director Prosecution Shiv Prakash Pandey told that during the Lok Sabha General Election in the year 2019, Mohammad Azam Khan had given a speech in the election rally on 7/4/2019 at Khata Naglia in Milak Assembly. That speech was inflammatory and FIR was registered in it under 153A, 505 1B and 125 Representation of the People Act, in which witnesses were examined and convicted by the court of MP MLA Court ACJM First on 27/10/2022, three years each in all sections .

Against this order, an appeal was filed on behalf of Azam Khan in the MP-MLA Court Sessions Court. After the debate in the appeal, the court accepted the appeal on May 24, 2023 and acquitted him and the decision of the appeal from the prosecution side was fully considered. Many things were found to be such that it felt that the appeal was unjustified. An appeal should be filed against this order in the Hon’ble High Court.
After making complete preparation and collecting all the materials, according to the rules, the government appeal is sent to the Uttar Pradesh government through the District Magistrate and then according to a process, after going through the government level, in the Hon’ble High Court. If it is filed, the proposal of that government appeal was signed on behalf of the District Magistrate Mr. Rampur yesterday and it is being observed to go to the UP government.

On the other hand, on the question asked on reaching the appeal in the High Court, Director Prosecution Shiv Prakash Pandey said that according to the process, the appeal should be passed from the district level within a month, then it is being sent from here within a month. If we had put the mock questions, time will be excluded in it and the remaining two months are for those who are government advocates from Uttar Pradesh government to the High Court, they should be filed before the High Court within three months. .
