Jabalpur High Court: In Madhya Pradesh, it is no longer safe for those who drive cars without wearing seat belts and those who drive two wheelers without wearing helmets. An undertaking has been given by the state government in the Jabalpur High Court that within the next 6 months every vehicle in the state will have a high security registration plate along with a helmet on the head of all two wheeler drivers and car drivers. Will wear seat belt. Taking this undertaking on record, a division bench of Chief Justice Ravi Malimath and Justice Vishal Mishra has fixed the next hearing on the matter on January 16, 2024.
Let us tell here that on the instructions of the Madhya Pradesh High Court, the state government on Wednesday (July 12) presented a complete action plan to ensure that the public follows the provisions of the Motor Vehicle Act. Additional Advocate General Harpreet Ruprah has given an undertaking that after January 15, 2024, if a single driver violates the above rules, the Transport Commissioner and the Additional Inspector General of Police of the department will be responsible for contempt action.
Guidelines issued to officers
The Additional Advocate General also told the court that the Transport Commissioner has issued guidelines to all the responsible officers regarding the High Security Registration Plate. Similarly, the compulsion of helmet for two-wheeler drivers and seat belt for car drivers must be followed. To do this, the AIG has issued instructions to the Superintendent of Police of every district.
Action is being taken only on paper in the state
In fact, Aishwarya Shandilya, a law student from Gwalior, had filed a public interest litigation in the Gwalior bench in the year 2021. Seeing the seriousness and scope of the matter, the Chief Justice got this petition transferred from the Gwalior bench to the main bench at Jabalpur. On behalf of the petitioner, Gwalior’s advocate Awadhesh Singh Tomar said that it is mandatory for two-wheeler drivers to wear helmets in the Motor Vehicle Act and Rules. He told that the Transport Department had issued a circular saying that the helmet should also be sold to the buyer from the agency from where the vehicle is purchased. It was told in the petition that action is being taken only on paper in the state, the rules are not being followed on the ground.
These things were said by the government
It goes on to say that even during the last hearing, the court had imposed a cost of Rs 25,000 expressing dissatisfaction over the report of the government. This matter has been causing trouble for the government for a long time. During the hearing, it was said on behalf of the government that a plan has been made to completely curb the use of helmets, seat belts, number plates, overloading etc.
