Yasin Malik in Supreme Court: Jammu and Kashmir Liberation Front (JKLF) chief Yasin Malik, who is serving life sentence in Delhi’s Tihar Jail in terror funding case, created a stir on Friday (July 21) when he appeared in the Supreme Court without permission.
With this, many questions arose on the security system. On the matter, Solicitor General Tushar Mehta even said, “Yasin Malik could have run away, he could have been forcibly abducted or he could have been killed.”
According to news agency PTI, Solicitor General Tushar Mehta has written a letter to Union Home Secretary Ajay Bhalla regarding the ‘lack of security’ amid the appearance of jailed Yasin Malik in the Supreme Court without the required permission.
What did the Solicitor General say in his letter to the Home Secretary?
Solicitor General Mehta wrote in the letter, “I am of the clear view that this is a serious lapse in security. A person like Yasin Malik with a terrorist and separatist background, who is not only guilty of funding terrorist activities, but also has links with Pakistani terrorist organizations, could have fled or could have been forcibly abducted or killed.
He further said in this that if any untoward incident happens, the security of the Supreme Court would also be in danger. Mehta pointed out that the Union Home Ministry has passed the order regarding Malik under provision 268 of the Code of Criminal Procedure (CrPC), which prohibits prison authorities from taking a convict out of prison premises for security reasons.
He wrote, “Considering that till the order issued under Section 268 of CrPC is in force, the jail authorities have no power to bring him out of the jail premises nor did they have any reason to do so .”
Mehta wrote, “I understand that this issue is so serious that it should again be brought to your notice personally so that appropriate action can be taken in this regard from your end.”
When Yasin Malik appeared in the court room, the hearing was going on
Yasin Malik appeared in the courtroom when Justice Suryakant was hearing the CBI’s plea against the September 20, 2022 order passed by the lower court in Jammu on the 1989 abduction of Rubaiya Sayeed, daughter of the then Union Home Minister Mufti Mohammad Sayeed.
The CBI has appealed against the decision of the Jammu court. The trial court has directed that Yasin Malik be produced physically before it on the next date of hearing and may also be given an opportunity to cross-examine prosecution witnesses in the Rubaiya Saeed kidnapping case.

Please tell that Yasin Malik was brought to the court premises in a jail van under the protection of armed security personnel without the permission of the court. He went to the court room which surprised everyone present there.

No order was given to bring Yasin Malik to court- SC
On this, the Supreme Court made it clear that no order was given to bring him (Yasin Malik) to the court. The court said that if necessary, he should be allowed to present his point only through video conferencing. Now the hearing will be held after 4 weeks.
